1. Liability & Indemnity Liability Mayan Cave Branch Tours acts only as an agent for the passengers regarding travel whether by private car, boat, aircraft, or any other conveyance. We assume no liability for injury, damage, loss, accident, delay, or irregularity which may be occasioned either by reason of defect, through the acts of God, dangers incident to the sea, fire, breakdown in machinery, acts of government or other authorities (de jure or de facto), wars (whether declared or not), hostilities, civil disturbances, strikes, riots, pilferage, epidemics, medical or customs regulations, or from any cause beyond the control of Mayan Cave Branch Tours. We do not accept responsibility for loss or additional expenses due to delay or changes in schedules. We reserve the right to accept or decline any passenger should such person's health or general deportment impede the operation of the services to the detriment of other passengers. Indemnity When you book an excursion with Mayan Cave Branch Tours, you accept responsibility for the proper conduct of yourself and your party. We reserve the right to terminate your tour or that of any member of your party due to misconduct. If your actions (or those of your party) cause damage to tour equipment, you agree to fully indemnify us against any claim made against us or on behalf of the owners of such equipment. 2. Important Disclaimers Mayan Cave Branch Tours cannot be held responsible or liable for trip cancellations or altered itineraries due to reasons beyond our control. There will be no refunds for no-shows, unused portions of tours, or Acts of God/circumstances beyond our control. Mayan Cave Branch Tours is not liable for any injury, death, accident, delay, or loss related directly or indirectly to tours/trips. Mayan Cave Branch Tours is not liable for any expense(s) incurred by loss or damage to the guest's personal property while participating in any tour. Risk Awareness: The Customer and/or Agent declare they are aware of the risks of traveling through Belize. While guides will inform guests of safety procedures, it is understood that guests participate in adventure-based packages at their own risk. 3. Force Majeure Mayan Cave Branch Tous shall not be liable for any failure or delay in the performance of its obligations under these Terms and Conditions arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control ("Force Majeure Events"). Force Majeure Events include, but are not limited to: Acts of God (e.g., hurricanes, earthquakes, floods, fires, or explosions). War, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riots, or other civil unrest. Government orders, laws, regulations, or actions, including embargoes or blockades. National or regional emergencies, epidemics, pandemics, or quarantine restrictions. Strikes, labor stoppages, or slowdowns. Interruption or failure of utility service or transportation (including airport closures or flight cancellations). In the event of a Force Majeure, Mayan Caves Branch Tours will make reasonable efforts to reschedule services or offer a credit for future use, subject to the recovery of any non-refundable costs already incurred by the company. 4. Cancellation & Refund Policy All cancellations must be made in writing (via email) to be valid. A. Tours & Shore Excursions 15 Days or More Prior: Refund of amount paid less upfront costs (e.g., tickets purchased, reservation fees). 7 Days Prior: 50% refund of amount paid less upfront costs. Less than 7 Days / No-Show: No refund. Cruise Ship Guarantee: Cruise Ship guests will receive a FULL REFUND in the event the ship does not port or cancels its stop in Belize. 4. Deposit & Payment Policy A. Tours Deposit: A deposit of 30% to 50% is required to confirm most tour reservations. Prepayment: You have the option to prepay your tour in full online. Email us at mayancavebranchtours535@gmail.com should you require paying the balance. Final Balance: The remaining balance is payable upon arrival in Belize via Cash. No-Show Penalty: Should you fail to show up for your tour without 48 hours' prior notice, Mayan Cave Branch Tours reserves the right to charge the full value of the excursion to the credit card on file. Confirmation: Itinerary and rates are not guaranteed until reservations are confirmed with a deposit/payment.
